2016-2017 Shared Residency Form
Transitional Kindergarten 2016-17
Placement of Transitional Kindergarten (TK) students will be done at the Educational Support Services Office for the 2016-17 school year. Your child is not guaranteed a specific school site for TK by residential address. To be included in the lottery for placement, you must come to the ESS between May 2 and May 13, 2016, to fill out the form choosing the top three schools you are interested in having your child attend. The lottery will be completed on Monday, May 16th, and notifications of placement will be made within that week. Anyone not participating in the lottery will be assigned to a school on a first come, first served basis to one of the remaining openings. You must bring 2 proofs of residency within OUSD boundaries (lease agreement or mortgage statement, utility bill, cable/Directv, homeowner or renter insurance, phone bill (landline only - no cell) with you to apply, but your residential address will not be used to determine placement. Your child must turn five years old between Sep 2 and Dec 2, 2016 to be age eligible. Registration instructions will be provided to you with your approved placement letter.

IMPORTANT INFORMATION REGARDING CONFIDENTIAL STUDENT DATA
A recent lawsuit against the California Department of Education (CDE) is impacting all school districts across the state, including Oceanside Unified School District. In April 2012, two organizations, the Morgan Hill Concerned Parents Association and the Concerned Parent Association, filed a lawsuit against the CDE alleging widespread, systemic non-compliance by local education agencies with special education laws. The suit also alleges the CDE fails to monitor, investigate and correct such non-compliance in accordance with the law. The CDE denies these allegations and is actively defending the litigation. Oceanside Unified School District was not involved in the lawsuit and is not the subject of any of the suit’s allegations. Nonetheless, as a part of this lawsuit, CDE has been ordered by the court to release all data it has collected on general and special education students since Jan. 1, 2008.

While submitting a form will not guarantee your student’s information will not be released, it is the only means for expressing an objection to the current order. The court also issued a Protective Order, which prohibits the plaintiff from disclosing any confidential information to anyone other than the parties, plaintiff’s attorneys and/or consultants, and the court. Thus, in no event is the information permitted to be disclosed to the public generally or used for any reason outside of this lawsuit, and all information must be returned to the CDE or destroyed at the conclusion of the lawsuit.

New Procedures for 504 Plans
It is the intent of the Oceanside Unified School District to locate, identify, evaluate and provide a free appropriate public education (“FAPE”) under Section 504 of the Rehabilitation Act of 1973 ("Section 504") to each student with a disability within its jurisdiction regardless of the nature or severity of the disability. Further, the District will provide regular or special education and related aids and services that are designed to meet the needs of each disabled student as adequately as the needs of non-disabled students. In addition to providing a FAPE to students with disabilities under Section 504, the District will not discriminate against students with a physical or mental impairment which substantially limits one or more major life activities, have a record of such an impairment, or those being regarded as having an impairment. Protections for these students are provided for elsewhere under District Board Policies and Regulations, state and federal law. (cf BP 1312.3.)
Students who, because of a Section 504 disability, need or are believed to need regular or special education and services are addressed in these procedures. Students who are identified as eligible for special education and related services under the criteria set forth in the Individuals with Disabilities Education Improvement Act of 2004 are not addressed under these procedures, as the needs of such students are provided for elsewhere under District Board Policies and Regulations, state and federal law, and Special Education Local Plan Area procedures.
